Terms of Use Agreement

Effective Date: January 1st, 2024

This Terms of Use Agreement (the “Agreement”) is entered into by and between Alex MacArthur (referred to as “Plausible Bootstrapper” and the user of the the Plausible Bootstrapper product (“Customer” or “User”). This Agreement sets forth the terms and conditions governing the use of the the Plausible Bootstrapper website and products.

1. Acceptance of Terms

By accessing the Plausible Bootstrapper website or using the products provided, the Customer acknowledges and agrees to comply with the terms and conditions set forth in this Agreement. If the Customer does not agree to these terms, this Customer should not use the the Plausible Bootstrapper product.

2. Product Description and Limitations

The Plausible Bootstrapper is a one-time-purchase digital product that aids in setting up a working instance of Plausible Analytics. The Plausible Bootsrapper is not affiliated with the creators of Plausible Analytics in any way.

For commercial clients, the customer is permitted to use the script for setting up a single instance of Plausible Analytics per client. Setting up additional instances will require the purchase of additional licenses.

For personal use, the customer is permitted to use the script to set up an unlimited number of instances.

3. Glitches, Outages, and Damages

In the event of a glitch or service outage, the Plausible Bootstrapper is not responsible for damages to the Customer’s website, business, or any associated assets. The Customer acknowledges that interruptions may occur and agrees that the Plausible Bootstrapper will not be held liable for any such issues. The scope of the Plausible Bootstrapper is only the setup of a running Plausible Analytics instance, and not its further maintenance or troubleshooting. Additionally, the Plausible Bootstrapper is not responsible for the maintenance or troubleshooting of the virtual machine on which the script is used.

4. Security Vulnerabilities

The Plausible Bootstrapper is not responsible for any security vulnerabilities inherent to the products used to power the Plausible Bootstrapper. The customer acknowledges that there may be risks associated with using digital products and agrees that the Plausible Bootstrapper will not be held liable for any security vulnerabilities that pertain to the code written within the product or the dependencies it uses.

5. Modification of Terms

This Terms of Use Agreement is subject to change at any time without prior notice. Customers may be notified of any changes through email. Continuing to use the Plausible Bootstrapper as a service after receiving notification of the updated terms will indicate the customer’s agreement to be bound by the revised Agreement.

This Agreement is effective as of the date the customer chooses to begin using the Plausible Bootstrapper product. By utilizing the product, the customer acknowledges and agrees to be bound by the terms and conditions outlined in this Agreement.

7. Suspension or Ban of Customers

The Plausible Bootstrapper reserves the right to deny or permanently ban a customer from using the product for any reason, at any time, without prior notice or liability. The determination of suspension or ban will be at the sole discretion of the Plausible Bootstrapper.

8. Payment Processing

The Plausible Bootstrapper processes payments through Stripe. The Plausible Bootstrapper does not manage any payment information directly and does not have access to customers’ payment details. The Customer’s use of Stripe’s services is subject to Stripe’s terms and conditions.

Payments will be collected once upon purchase. No further payments will be processed for a single customer, and the customer may use the script as often as they like on any number of projects.

9. Refunds

The Plausible Bootstrapper offers refunds to customers who request them within 60 days of their initial purchase. To initiate a refund request, customers must contact the Plausible Bootstrapper’s customer support and provide the necessary details.

10. Resale and Copying Restrictions

The customer acknowledges and agrees not to:

Resell the Plausible Bootstrapper or any part thereof.
Copy, reproduce, or incorporate the Plausible Bootstrapper into any other software or product.

Any violation of these restrictions constitutes a breach of this Agreement and may result in the suspension or termination of the customer’s access to the Plausible Bootstrapper without prior notice.

11. Entire Agreement

This Agreement constitutes the entire agreement between the customer and the Plausible Bootstrapper, superseding any prior agreements or understandings, whether written or oral, relating to the subject matter herein.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be binding and enforceable to the fullest extent permitted by law.

By using the the Plausible Bootstrapper service, the customer acknowledges that they have read, understood, and agreed to abide by the terms and conditions set forth in this Terms of Use Agreement.
